These Terms and Conditions apply to the use of the Near & Dear Concierge website and services. By using our website, contacting us, booking services, or accepting services from Near & Dear Concierge, you agree to these Terms and Conditions. Please read them carefully.
1. About Our Services
Near & Dear Concierge provides non-medical concierge, lifestyle support, property support, and transition support services for seniors, families, busy households, homeowners, and property owners. Our services may include:
- Companionship and friendly check-ins
- Errands and appointment coordination
- Transportation coordination
- Technology help
- Family updates
- Grocery and pharmacy pickup
- Home watch and property checks
- Plant care and pet care
- Mail and package pickup
- Contractor and vendor coordination
- Decluttering and organizing support
- Downsizing and move coordination
- Post-hospital home setup
- Transition and project coordination
Specific services will depend on availability, location, client needs, and agreed service scope.
2. Non-Medical Service Disclaimer
Near & Dear Concierge is not a medical, nursing, home health care, personal care, emergency response, or regulated care provider. We do not provide: medical care, nursing care, personal hygiene care, medication administration, emergency response, diagnosis, treatment, or health advice, or regulated health services.
In an emergency, call 911 immediately. If a client requires medical care or regulated support, the client or family must arrange those services through qualified professionals.
3. No Emergency Monitoring
Our services are not designed for emergency monitoring, crisis response, or urgent medical situations. Any check-ins, home visits, or support services are provided according to agreed schedules and availability. We are not responsible for providing immediate emergency response.
4. Booking and Service Availability
Services are subject to availability, service area, scheduling, staffing, weather, safety, and other practical considerations. We reserve the right to decline, pause, or discontinue services if:
- The requested work is outside our service scope
- The environment is unsafe
- Required information or access is not provided
- Payment is overdue
- The service requires medical, personal care, or regulated support
- The request creates unreasonable risk to our team, contractors, clients, pets, property, or others
5. Client Responsibilities
Clients are responsible for providing accurate and complete information, including:
- Service address
- Contact information
- Access instructions
- Alarm codes, gate codes, keys, or lockbox details, where applicable
- Pet instructions
- Plant care instructions
- Authorized family contacts
- Contractor or vendor details
- Appointment or errand details
- Relevant safety information
- Payment information
Clients are responsible for ensuring that Near & Dear Concierge has permission to access the property, coordinate with vendors, or communicate with authorized family members.
6. Property Access, Keys, and Security
If we are given access to a home or property, we will take reasonable care in handling keys, access codes, lockboxes, and entry instructions. Clients remain responsible for maintaining insurance, security systems, locks, alarms, and property safety.
Near & Dear Concierge is not responsible for pre-existing property conditions, hidden defects, system failures, weather-related damage, third-party actions, or issues outside our reasonable control.
7. Property Checks and Home Watch Services
Home watch or property check services are visual and observational in nature. They are not a guarantee that damage, theft, leaks, pests, system failures, or other issues will not occur.
Where requested, we may provide notes, photos, or updates after visits. These updates are intended to document visible observations and completed tasks, not to replace professional inspections, insurance assessments, security services, or emergency response.
8. Contractor and Vendor Coordination
Near & Dear Concierge may help schedule, coordinate, provide access to, or follow up with third-party contractors, vendors, movers, cleaners, trades, delivery providers, or other service providers.
Unless otherwise agreed in writing, third-party providers are independent from Near & Dear Concierge and are responsible for their own work, licensing, insurance, pricing, safety, and service quality. We may recommend or coordinate trusted providers, but we do not guarantee third-party availability, performance, timelines, or outcomes.
9. Payments, Fees, and Reimbursements
Fees will be communicated before services begin whenever practical. Services may be billed hourly, by package, by project, or by another agreed arrangement. Clients are responsible for:
- Service fees
- Applicable taxes
- Third-party costs
- Delivery fees
- Reimbursements for approved purchases
- Contractor/vendor invoices
- Parking, ferry, travel, or other agreed expenses where applicable
Payment terms, deposits, cancellation fees, or minimum charges may be outlined in a separate quote, invoice, service agreement, or booking confirmation.
10. Cancellations and Rescheduling
Clients should provide as much notice as possible for cancellations or schedule changes. Near & Dear Concierge may apply cancellation fees, minimum charges, or rescheduling fees if insufficient notice is provided, especially where staff time, travel, contractor coordination, or third-party bookings have already been arranged. Any specific cancellation terms should be confirmed in the applicable quote, invoice, service agreement, or booking confirmation.
11. Online, Phone, or Email Bookings
If services are booked online, by phone, text, or email, additional consumer protection rules may apply depending on the type of contract and circumstances. We aim to provide clear information about services, pricing, cancellation terms, and payment before work begins.
12. Photos, Notes, and Family Updates
We may take photos, prepare written notes, or send updates to document services, property checks, completed tasks, or visible concerns. Photos and updates will be shared only with the client and authorized contacts unless otherwise required by law or reasonably necessary to coordinate requested services. Clients must tell us in advance if they do not want photos or written updates provided.
13. Privacy
Personal information is handled according to our Privacy Policy. By using our services, you agree to the collection, use, and disclosure of personal information as described in that policy.
14. Safety
Near & Dear Concierge may refuse or stop work if conditions are unsafe, including but not limited to aggressive animals, unsafe access, hazardous materials, severe weather, security concerns, hostile behaviour, or any situation that creates unreasonable risk.
15. Limitation of Liability
To the fullest extent permitted by law, Near & Dear Concierge is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of enjoyment, lost income, emotional distress, or damages arising from third-party service providers, pre-existing property conditions, or events outside our reasonable control. Nothing in these Terms limits liability where it cannot legally be limited.
16. No Guarantee of Outcome
We provide thoughtful, reliable, and professional coordination and support, but we cannot guarantee specific outcomes, timelines, contractor performance, property conditions, delivery availability, or third-party actions.
17. Website Information
Information on our website is provided for general information only. It may change without notice. Website content does not create a service agreement unless confirmed directly by Near & Dear Concierge.
18. Changes to These Terms
We may update these Terms and Conditions from time to time. The updated version will be posted on our website with a revised effective date.
19. Governing Law
These Terms and Conditions are governed by the laws of British Columbia and the applicable laws of Canada.
